Sale of Plants - Terms & Conditions

1. Payment Terms

  • All plant orders are payment with order, unless otherwise agreed in writing.
     

  • Where a customer is awaiting a warrantied planting quotation, plants can only be reserved once payment for the plants has been received in full.
     

  • We reserve the right to delay delivery, collection, or planting where payment has not been received by the agreed date.
     

  • Title to goods remains with Tendercare until payment has been received in full.
     

2. Quotations

  • Plant quotations are valid for 15 days, unless otherwise stated.
     

  • Once a quotation for plants has been accepted, we aim to provide a planting quotation within 48 hours, subject to complete site information and access details being available.
     

  • All quotations are subject to plant availability at the time of acceptance.
     

3. Order Cancellations

  • Once plants are tagged and reserved, if an order is cancelled within 7 days, we reserve the right to charge 10% of the order value to cover administration and de‑tagging costs.
     

  • After 7 days, orders may only be cancelled by agreement and will incur a minimum 30% cancellation charge of the order value.
     

  • Where stock is bought in specifically for a customer based on a supplied photograph, the cancellation charge will be 100% of the order value.
     

  • If the supplied plant does not reasonably match the agreed photograph, a full refund will be issued.
     

4. Plant Reservation & Risk

  • Tagged and reserved plants are held exclusively for the customer and removed from general sale.
     

  • Risk in the plants passes to the customer once plants are tagged and paid for in full, although we will continue to care for plants while held on site in line with good nursery practice.
     

5. Deliveries & Collection

  • Delivery charges are based on vehicle size and postcode.
     

  • Delivery prices include delivery and off‑loading of plants up to 130L pot size to a flat, hard surface at the front of the property.
     

  • Orders are normally scheduled for delivery within 10 days (South East) and 20 days (elsewhere).
     

  • All deliveries are accompanied by a delivery note. The purchaser must have a representative available to check, sign for, and accept delivery.
     

6. Delivery Off‑Loading

  • Deliveries are made from the public highway unless otherwise agreed.
     

  • Plants up to 130L will be off‑loaded using a tail lift and can be wheeled on flat surfaces only.
     

  • For pots over 130L, specialist handling equipment may be provided at additional cost or included in our planting service.
     

  • If stock is unloaded and later found to be unsatisfactory, defects must be reported within 3 days of delivery and prior to planting.
     

7. Planting Services & Warranty

  • A warranty applies only where plants are supplied and planted by Tendercare and where our aftercare guidance is followed.
     

  • The warranty does not cover plant failure resulting from:
     

    • Extreme weather conditions
       

    • Poor soil or drainage not disclosed at quotation
       

    • Inadequate watering or maintenance
       

    • Pest, animal, or third‑party damage
       

    • Subsequent works near the plants
       

  • Warranty claims must be made in writing and supported by photographs within the warranty period.
     

8. Site Access & Preparation

  • Customers are responsible for ensuring safe and suitable access for delivery vehicles, lifting equipment, and planting teams.
     

  • Any delays or additional costs due to restricted access or unsuitable site conditions may be charged additionally.
     

  • We reserve the right to postpone delivery or planting if site conditions are unsafe or unsuitable on arrival.
     

9. Weather & Seasonal Considerations

  • Delivery and planting dates are subject to weather conditions and seasonal suitability.
     

  • We reserve the right to delay works where conditions would compromise plant health or establishment.
     

10. Collections from the Nursery

  • A minimum of 24 hours’ notice is required for collections.
     

  • Handling equipment is required for stock over 50L, and advance notice is essential.
     

  • Vehicles collecting plants must have suitable covering to comply with plant handling best practice during transit.
     

11. General Terms

  • This list supersedes all previous terms.
     

  • Prices are exclusive of VAT; VAT Registration Number: 442 5638 48.
     

  • All items are offered subject to availability.
     

  • All plants are believed to be true to name; our liability is limited to the invoice value of any plant found to be incorrectly named.
     

  • After acceptance of delivery or collection (other than where covered by planting warranty), no warranty is given.
     

  • Credit notes are valid for 12 months from issue; records are kept for a minimum of six years.
     

  • Customer data is handled in accordance with applicable data protection legislation.
     

  • These Terms & Conditions are governed by the laws of England and Wales.
